Service Terms
Effective date: 1 May 2025
These Service Terms (the "Terms") set out the rules for accessing and using the website Novary and the AI market platform, together called the "Service", operated by Novary Inc. ("Novary", "we", "us" and "our"). By accessing or using the Service, you agree to these Terms. If you disagree, you must not use the Service.
1. Who May Use the Service
You must be 18 or older to access the Service. By using it, you confirm that you satisfy this age requirement and can legally agree to these Terms. The Service is not offered where applicable law prohibits its use.
2. Creating an Account
Full access requires an account containing accurate, current and complete details. You must protect your login information and remain responsible for activity carried out through your account. Notify us promptly at if you believe someone has accessed it without permission.
We may suspend or close accounts that breach these Terms, provide misleading information or participate in fraudulent or abusive activity.
3. The Service: Scope and Constraints
Novary offers AI-assisted market analysis, trading signals and optional automated order execution through linked brokerage accounts. The Service is supplied for information and analysis only.
- Novary does not hold, control or safeguard your funds. Your capital remains in your own brokerage or exchange account.
- Connections to your broker may use API keys with read-only and execution permissions. These credentials do not permit fund withdrawals.
- Historical strategy or signal performance should not be treated as an indication of future performance.
- Every form of trading carries loss risk, including the risk of losing your original capital.
4. No Investment Guidance
No content on the platform Novary is financial, investment or trading advice, or any other form of advice. AI signals and analytics are supplied for information only. Consider obtaining advice from a suitably qualified financial adviser before making investment decisions. Novary is not a registered investment adviser, broker-dealer or financial planner.
5. Charges and Billing
Certain features may require a paid subscription. Current charges appear on the pricing page and may change with 30 days’ notice. Applicable taxes are excluded and remain your responsibility. Plans are charged in advance monthly or annually. At our discretion, a refund may be available within 14 days of the first charge for new subscribers only.
6. Permitted Use
You must not:
- Use the Service unlawfully or contrary to an applicable rule or regulation.
- Reverse-engineer, decompile, disassemble or attempt to obtain the platform source code.
- Run scripts or other automated tools to scrape, crawl or collect Service data.
- Resell, sublicense or use any portion of the Service commercially without written permission.
- Damage, interrupt or otherwise impair the Service or its supporting infrastructure.
- Carry out market manipulation, front-running or another activity prohibited by financial regulation.
7. Intellectual Property Rights
All software, content, algorithms, marks and trade secrets provided through the Service belong exclusively to Novary or its licensors. These Terms transfer no ownership or other interest in that material. Our marks and logos may not be used without prior written approval.
8. Warranty Disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Novary DOES NOT WARANT THAT THE SERVICE WILL OPERATE WITHOUT INTERUPTION, ERORS, VIRUSES OR OTHER HARMFUL ELEMENTS.
9. Liability Cap
TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW, Novary WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE LOSS, INCLUDING LOSS OF PROFITS, DATA, TRADING OUTCOMES OR BUSINESS INTERUPTION, ARISING FROM ORELATED TO USE OF THE SERVICE, EVEN IF WARNED THAT SUCH LOSS COULD OCCUR. OUR TOTAL LIABILITY TO YOU WILL NOT EXCEED THE AMOUNT YOU PAID TO Novary DURING THE 12 MONTHS BEFORE THE CLAIM.
10. Your Indemnity Obligations
You undertake to indemnify, protect and release Novary and its directors, officers, staff and representatives from claims, obligations, harm, losses or costs, including reasonable legal expenses, resulting from or connected with your use of the Service, breach of these Terms or infringement of another party’s rights.
11. Ending Access
You can close your account through its settings or by contacting . We may end or suspend access immediately after a breach of these Terms. Once access ends, your permission to use the Service stops and account information may be removed in line with our Privacy Policy.
12. Applicable Law and Disputes
These Terms are governed by the laws of Novary, excluding conflict-of-law rules. Disputes will first be referred to binding arbitration in 1 Sandton Drive, Sandton, Johannesburg, South Africa under American Arbitration Association rules. Users in the EU or United Kingdom may also bring proceedings before their competent local courts.
13. Updates to These Terms
We may amend these Terms. For material revisions, we will give at least 14 days’ notice by email or through a platform banner. Continuing to use the Service after the effective date means you accept the revised Terms.
